Terms of payment established by the Dutch Organization of Midwives, having its registered office in Utrecht; filed with the Clerk of the District Court in Utrecht on June 21, 1996, under number 165/1996. Full or partial obstetric care provided by an obstetrician or her/his observer is subject to the following conditions:
1. Payment term
Payment for midwifery services rendered must be made by the client to the midwife with whom she is under care in connection with her pregnancy within 30 days of the billing date, without any deduction, set-off or discount.
2. Interest
If the term of payment is exceeded, the client is deemed to be in default without notice of default. From the due date of the account, the client shall also owe monthly interest of 1% on the outstanding amount, with part of a month counting for a full month.
3. Collection costs
If the client remains in default of payment after demand for payment, all judicial and extrajudicial collection costs which the midwife must incur to obtain full payment shall be borne by the client without further notice of default. Recovery costs shall be a minimum of 15% of the claim, plus VAT due on the costs, to the extent that the midwife cannot set them off. Recovery costs include the cost of legal assistance, use of a collection agency, bailiff or lawyer.
4. Proof
The administrative records of the midwife shall be decisive in determining the amount owed by the client, unless the client provides express evidence to the contrary.
5. Dispute Resolution
All disputes arising from an agreement subject to these terms and conditions shall be submitted to the competent court of the debtor’s domicile. If the dispute between the parties does not fall within the jurisdiction of the subdistrict court, the midwife shall be entitled to bring the dispute before the competent court in Utrecht.
